PRIVACY POLICY

1. PURPOSE

 

LUNOVA LAW (services provided by Luanne Schlosser Legal Prof Corp. and/or her affiliates and contractors) (“LUNOVA LAW”, “we”, “us”, “our”) is committed to maintaining the privacy of individuals and protecting Personal Information in our custody and control in accordance with those privacy laws applicable to LUNOVA LAW.  This Policy describes how we collect, use, disclose, and protect the Personal Information of those clients of LUNOVA LAW, employees and independent contractors, individuals who visit the website www.lunova.ca (our “Website”), and other individuals who choose to provide information to us.  We may amend this Policy from time to time, and without notice, in order to comply with applicable laws.

 

2. SCOPE

 

In this Policy, Personal Information” means any information that is defined to be personal information under applicable privacy laws.  Usually, this refers to any information about an identifiable individual or any information that can be used to identify an individual and may include, for example, your name and home address, your date of birth and gender, your occupation, your personal financial records or credit information, or any personal identification numbers.  In most circumstances, Personal Information does not include the business contact information of a representative of an organization.  Publicly available information, such as information in a public directory, is not Personal Information under this Policy.

 

3. CONSENT/TRANSPARENCY/NOTICE

 

We will only use your Personal Information in accordance with this Policy unless otherwise required by applicable law.  Our Website does not automatically gather Personal Information from you.  We would only obtain this information if you supplied it to us by sending an email and/ or inquiry form.  However, as you navigate the Website, certain passive information may also be collected about your visit, including through cookies and similar technologies.

 

We may collect, use, or disclose Personal Information for the purposes identified at the time of collection, as otherwise permitted or required by applicable law, or for any of the following purposes:

 

·       to provide services to you or to allow you to access to the Website;

·       to comply with our legal obligations and regulatory requirements;

·       to provide information to anyone working with or for us as needed for the provision the services;

·       to develop and manage our business and operations;

·       to respond to your questions and concerns;

·       to detect and protect us and third parties from error, negligence, breach of contract, fraud, theft or other illegal activity, and which may include sharing Personal Information with our insurers, and to otherwise communicate with our insurers; or

·       for any other purpose for which we have obtained your consent.

 

Providing us with your Personal Information is always your choice. When you request services from us, we ask that you provide information that enables us to respond to your request and/or provide you with our services. In doing so, you consent to our collection, use and disclosure to appropriate third parties of such Personal Information for these purposes. If we merge with another party, your consent will be implied to transfer your information to our successor for the same purposes as set out in this Policy.

 

4.  LIMITED USE, DISCLOSURE AND RETENTTION

 

We will only collect such information that is deemed necessary to meet the purpose for which such Personal Information is collected.  We may use third party service providers to process or deal with records, documents, data and information on its behalf, and such records, documents, data and information may include Personal Information.  To ensure the confidentiality and security of such Personal Information by third party service provides, we will use contractual and similar measures with such service providers, including contractual non-disclosure provisions.

 

5.   CASL COMPLIANCE

 

LUNOVA LAW complies with Canada’s anti spam legislation, typically known as “CASL” which prohibits the sending of commercial electronic messages (“CEMs”) without adequate consent.  It is our policy to not send CEMs without first having received valid legal consent from the recipient, and we always use the unsubscribe mechanism in our CEMs, as is required under CASL.

 

6.  DATA HOSTING


LUNOVA LAW uses "cloud computing" third party service providers.  Such service provides may be either in or outside Canada, and the data housed, hosted and processed by such providers may reside in or outside of Canada, and may include Personal Information about individuals.

 

7.  DATA SECURITY

 

The security of your Personal Information is very important to us. We use physical, electronic, and administrative measures designed to secure your Personal Information from accidental loss and from unauthorized access, use, alteration, and disclosure.  We protect your Personal Information by choosing appropriate service providers and having contractual safeguards in place with those vendors.

 

8.  DATA RETENTION

 

Except as otherwise permitted or required by applicable law or regulation, we will only retain your Personal Information for as long as necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.

 

9.  ACCESSING AND CORRECTING YOUR PERSONAL INFORMATION

 

It is important that the Personal Information we hold about you is accurate and current. Please keep us informed if your Personal Information changes. By law you may have the right to request access to and to correct the Personal Information that we hold about you.

 

We may request specific information from you to help us confirm your identity and your right to access, and to provide you with the Personal Information that we hold about you or make your requested changes. Applicable law may allow or require us to refuse to provide you with access to some, or all of, the Personal Information that we hold about you, or we may have destroyed, erased.  If we cannot provide you with access to your Personal Information, we will inform you of the reasons why, subject to any legal or regulatory restrictions.

 

We will provide access to your Personal Information, subject to exceptions set out in applicable privacy legislation.  Examples of such exceptions include:

 

·       Information protected by solicitor-client privilege;

·       Information that is part of a formal dispute resolution process;

·       Information that is about another individual that would reveal their Personal Information or confidential commercial information; and/or

·       Information that is prohibitively expensive to provide.

11.  THIRD PARTY LINKS AND PAYMENT PROCESSOR

 

The Website may contain links to other websites operated by third parties. Please note that this Policy applies only to the Personal Information that we collect or receive from third parties with your consent and we cannot be responsible for Personal Information that third parties may collect, store and use, including through their websites. You should always read the privacy policy of each website you visit carefully.

 

We use a third-party payment processor for online payments made to us.  In connection with the processing of such payments, we do not retain any Personal Information or any financial information such as credit card details.  Instead, all of that information is provided directly to our third-party processor, whose use of your Personal Information is governed by their privacy policy and terms.

For any questions, comments or suggestions regarding this Policy or the Personal Information protection practices of LUNOVA LAW not discussed in this Policy, you can write to LUNOVA LAW by email or regular mail at the coordinates below. If you think that we are not meeting our obligations with respect to the protection of Personal Information, we will investigate such complaints and if they are justified, will take appropriate measures to correct the situation.
